IMPORTANT REVIEW CONDITION Publish this Notice only after counsel confirms that Apteum Neurosurgery & Spine is a HIPAA covered entity, an affiliated covered entity, or a participant in a valid joint notice arrangement. If Apteum Neurosurgery & Spine acts only as a business associate or referral/network service, this draft must be revised to reflect that role.

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION MAY BE USED AND DISCLOSED AND HOW AN INDIVIDUAL MAY ACCESS IT.

1. Our Duties We are required to protect the privacy and security of protected health information, provide this Notice, follow the Notice currently in effect, and notify affected individuals following a breach of unsecured protected health information as required by law.

2. Uses and Disclosures We may use or disclose protected health information for treatment, payment, and healthcare operations; to business associates under appropriate agreements; and when permitted or required for public health, health oversight, law enforcement, judicial or administrative proceedings, workers’ compensation, organ donation, research, averting serious threats, military or national-security functions, and other purposes permitted by law. Additional protections may apply to psychotherapy notes, substance-use-disorder records, reproductive-health information, genetic information, and information protected by state law.

3. Authorization Uses or disclosures not otherwise permitted generally require written authorization. An authorization may be revoked in writing, except to the extent action has already been taken in reliance on it. We will not sell protected health information or use it for prohibited marketing without authorization.

4. Individual Rights Subject to legal limits, an individual may request access to and copies of records; request amendment; request restrictions; request confidential communications; obtain an accounting of certain disclosures; receive a paper copy of this Notice; choose someone to act on the individual’s behalf; and file a complaint without retaliation.
